Counsel for the parties have been heard.

During the course of hearing, an understanding has been arrived at.

The instant writ petition is being disposed of by way of consent and on the following terms and conditions: - (i) A proposal to settle the loan account of the borrower for a sum of Rs. 65.00 lakhs in all has been accepted by respondent No. 3-Housing Development Finance Corporation.

(ii) Undertaking has been furnished on behalf of the petitioners that a sum of Rs. 10.00 lakhs would be deposited by 01.03.2023, a further sum of Rs. 15.00 lakhs by 31.03.2023, a further sum of Rs. 15.00 lakhs by 30.04.2023 and the entire balance amount of Rs. 25.00 lakhs positively by 31.05.2023.

 (iii) Undertaking is also furnished on behalf of the petitioners that no further applications for extension of time would be filed;

(iv) the interim protection granted by this Court vide order dated 05.09.2022 would enure in favour of the petitioners till 31.05.2023 and in the event of even a single default, such interim order shall stand automatically vacated.

(v) It is further clarified that in the eventuality of a default, the amount that may have been deposited by the petitioners would stand appropriated.

Writ petition is disposed of in the aforesaid terms. Pending application(s), if any, shall also stand disposed of.
