  CRM-43890-2021 This is an application seeking permission to withdraw the main petition i.e CRM-M-39655-2020, with a liberty to file a fresh one. Learned counsel for the applicant-petitioner submits that the applicant-petitioner has filed the main petition seeking issuance of directions to official respondents No.2 and 3 to register an FIR against respondents No.4 and 5, for the offence under Sections 420, 465, 467, 468, 471, 120B IPC. He further submits that, post filing of the present petition, an FIR No.20 dated 22.09.2021 under Sections 420, 465, 467, 468, 471, 120-B IPC, has been registered against respondents No.4 and 5. He, thus, prays for withdrawal of the main petition. Notice of the application.

 On the asking of this Court, Mr. Davinder Bir Singh, DAG Punjab, accepts notice and submits that he has no objection if the present application is allowed. He has also not disputed the aforesaid factual position.

In view of the above, the present application is allowed. Applicant-petitioner is permitted to withdraw the main petition i.e. CRM-M-39655-2020.

CRM-M-39655-2020 In view of the orders passed in the aforesaid application, the present petition stands dismissed as withdrawn, with the liberty aforesaid, if so advised.
