Inasmuch as the contempt proceedings in COСР2867 2020 (O&M) have been dropped by the learned Single Judge, in view of the Speaking Order dated 10.06.2021, noting that no case of willful disobedience of the order dated 23.08.2018 passed by the learned Division Bench was made out. In our considered view, the appeal against the same is not maintainable.

We are inclined to set aside the impugned order passed by the High Court by giving liberty to the respondent(s) to avail an appropriate remedy, in accordance with law.

The appeal stands disposed of with the aforesaid liberty, accordingly."
