NIDHI GUPTA J. (Oral) Prayer in this petition filed under Section 438 Cr.P.C. is for grant of anticipatory bail to the petitioner in case FIR No. 0116 dated 25.7.2022, under Sections 406 and 498-A IPC, registered at Police Station Bullowal, District Hoshiarpur. Vide last order dated 27.3.2023, the parties were directed to appear before the Mediation and Conciliation Centre of this Court. As per report of the Mediator dated 13.7.2023, the mediation has been successful and the parties have entered into Settlement Agreement, which, in original, is annexed with the report of the Mediator, as per which the matter has been settled in Rs.4,00,000/- in all, which would be paid by the petitioner to the complainant-wife in four installments on different dates. 2023:PHHC:098573 CRM-M-39690-2022 (O & M) of the said Settlement Agreement, the petitioner brings a Demand Draft of Rs.50,000/- as first installment and the same is handed over to the complainant-wife in the Court, which has been accepted by the complainant-wife. Photocopy of the said Demand Draft is taken on record.
Learned counsel for the parties submit that in view of the fact that the matter in between the parties has been settled, the present petitioner has been rendered infructuous and the same may be disposed of as such.
Ordered accordingly.
