The jurisdiction of this Court has been invoked under Section 483 BNSS for grant of regular to the petitioner in case FIR No.34, dated 05.03.2024 (Annexure P-1) under Section 407, 120-B IPC, registered at Police Station Sadar Sri Muktsar Sahib, District Sri Muktsar Sahib, in the interest of justice.

In response to the previous order dated 07.07.2025, reply by way of affidavit of Naveen Kumar, PPS, Deputy Superintendent of Police, Sub Division Sri Muktsar Sahib, District Sri Muktsar Sahib has been filed today in Court by the learned State counsel. The same is taken on record and a copy thereof has been supplied to learned counsel for the petitioner. 3.
Learned State counsel has referred to Para 7 (C) of the reply and has submitted that it is proved on record that 700 wheat bags were loaded in Truck No.RJ-46GA-3782 (wrongly mentioned RJ-14GA-3782) and it is also proved that the wheat did not reach at its destination, which was assigned for its transportation and delivery. Therefore, the allegations under Section 407 TRIPTI SAINI 2025.07.29 09:27 I attest to the accuracy and integrity of this document
CRM-M-33351-2025 (O&M) -2and 120 IPC qua fraudulently embezzled the government property and misappropriation is fair and prima facie offence against the petitioner is made out.

At this stage, learned counsel for the petitioner seeks permission to withdraw the present petition.
