The petitioner has prayed for a writ in the nature of mandamus to direct the respondents to take suitable action against respondent no.5-Sarpanch for illegal encroachment over the panchayat land for his personal use. Counsel for the petitioner has though argued vehemently but failed to bring on record any cogent evidence to prove illegal encroachment/ possession of respondent no.5 on the land belonging to the Panchayat. In view thereof, I do not find any reason to interfere in the present petition and hence, the same is hereby dismissed being denuded of any merit, though without any order as to costs.
