The petitioner has prayed for the issuance of a direction to respondents no.2 and 3 to take action against respondent no.5 and remove her from the post of Sarpanch as she has been using JCB Machines for the earth filling work instead of engaging the labour under the Mahatma Gandhi National Rural Employment Guarantee Act, 2005 (hereinafter referred to as the "MANREGA").

The petitioner has placed on record the photographs Annexure P-3 of a JCB machine but has failed to lead any cogent evidence to connect the same with respondent no.5, therefore, in the absence of any evidence, I do not find any ground to interfere in the present petition. Dismissed.
