Nirmal Singh v. Xen Punjab State Power Corporation Ltd And ORS
IN THE HIGH COURT OF PUNJAB AND HARYANA AT
CHANDIGARH CWP-6937-2015 (O & M) Date of decision: 26.09.2017 Nirmal Singh ....Petitioner(s) V/s XEN, Punjab State Power Corporation Ltd. and ors.
...Respondent(s)
CORAM:
HON'BLE MR. JUSTICE RAJAN GUPTA
Present:
Ms. Amanpreet Kaur, Advocate, for Mr. HNS Gill, Advocate, for the petitioner.
Ms. Gurdeep Kaur, Advocate, for PSPCL.
Ms. Baljeet Kaur Bhullar, Advocate, for respondent No.4. Mr. Manbir Singh Batth, Advocate, for respondent No.5. **** Rajan Gupta, J. (Oral) Petitioner has impugned the award dated 13.11.2014 passed by the Permanent Lok Adalat whereby his plea for stopping supplying of electricity to respondent No.4 has been rejected. At the outset, learned counsel appearing for respondent No.5Corporation submits that no NOC from the Municipal Council is required for the purpose of issuance of connection. He has referred to circular, Annexure R-5/1 in this regard. Besides, any petition, for disconnecting power supply at the behest of resident of the area, was not maintainable before the Permanent Lok Adalat.
I find substance in these pleas. There is, thus, no merit in the present petition. Same is hereby dismissed. Petitioner shall, however, be at liberty to avail alternative remedy, if any.
