Grievance set forth by petitioners in this writ petition is that agricultural land measuring 395 acres has been leased out by respondent no.3 without following the procedure as prescribed under Rule 6 and Section 15(2)(f) of the Punjab Common Land (Regulation) Rules, 1964, (as applicable to the State of Haryana).

Learned counsel for the petitioner submits that petitioner had earlier taken about 17 acres of land on lease but now said land has been leased out to different persons of village, who are close to the Ex-Sarpanch, without following any kind of procedure. Learned counsel further submits that no publication was made in newspaper or proclamation carried out and without any auction being conducted, land in question has been leased out for about Rs.11,000/- per acre whereas petitioner is ready and willing to pay a sum of Rs.20,000/- per acre.

CWP-19679-2022 -2It is not denied that petitioner has an alternate efficacious remedy under the Punjab Common Land (Regulation) Act, 1964, (as applicable to Haryana) therefore, this writ petition is not maintainable. Needless to say, petitioner is at liberty to avail the remedy available to him. In case, petitioner approaches the competent authority within a period of one week from receipt of certified copy of this order, it is directed that the matter be decided by the competent authority expeditiously and preferably within 30 days, after affording opportunity to all concerned/affected parties.
