The petitioners through instant petition under Article 226/227 of the Constitution of India are seeking setting aside of order dated 06.02.2026 whereby respondent No.4-Arbitrator-cum-Commissioner, Rupnagar Division, Rupnagar, Punjab has dismissed their claim for enhancement of compensation filed under Section 3G(5) of National Highway Act, 1956. They are further seeking direction to respondent No.4 to decide their claim petition in the light of award dated 10.05.2021 (Annexure P-4) which relates to similarly situated landowners of the same village.

As per petitioner's pleadings, land situated in Village Dhakoli, Tehsil Zirakpur, District SAS Nagar (Mohali) vide award dated 25.01.2010 SUDEEPAK KUMAR 2026.07.01 17:31 I attest to the accuracy and integrity of this document

-2was acquired for the purpose of widening of National Highway-22. It was acquired @ ₹8,000/- per sq. yards which was less than the Collector rate. They filed reference/claim petition dated 20.03.2017 under section 3G(5) for enhancement of compensation before respondent No.4. They approached this Court by way of CWP-1554-2025. A Coordinate Bench of this Court by way of interim order dated 24.12.2025 directed expeditious adjudication before Ld. Arbitrator. The reference application vide order dated 06.02.2026 has been dismissed on the ground of limitation. 3.

Learned counsel for petitioners seeks permission to withdraw with liberty to approach learned District Judge in terms of Section 34 of the Arbitration and Conciliation Act, 1996.

Disposed of as withdrawn with aforesaid liberty. 5.

The Court is sanguine that if petitioners approach learned District Judge, their petition would be adjudicated expeditiously. 6.
