**** RITU BAHRI , J.

Petitioner-Kuldeep Singh applied for the post of Driver against advertisement dated 14.08.2015 for the recruitment of Heavy Vehicle Contract/Daily wages basis and was issued Roll No. 0079 and was allowed to appear in test on 24.12.2015 at Murthal Distt. Sonepat. Petitioner appeared and was shown as disqualified during Dug Test and was shown failed in the result sheet and reply under RTI Act. There was no proper arrangement of lightening which was otherwise necessary for Dug Test, Zig Zag Test, 8 shape test and road test. Petitioner also raised objection by giving representation dated 31.12.2015 regarding non-lightening and proper facility Learned counsel for the petitioner has referred to result GAURAV ARORA 2016.04.12 16:22 I attest to the accuracy and integrity of this document

C.W.P No. 6104 of 2016 -2sheet whereby it has been mentioned that test will be held on 28.12.2015 due to shortage of time and in remarks column, it has been mentioned that candidate at Sr. No. 41 and 42 were present but test is not taken due to bad light/shortage of time.

The argument of petitioner is liable to be rejected on the ground of delay, as the test was to be held on 28.12.2015 of other candidate mentioned at Sr.No. 41 and 42 and if the petitioner was having any grievance, he should have come before that date but the petitioner kept quite for almost 03 months and has filed the present writ petition on 29.03.2016 and there is no explanation given for filing the present writ petition after a gap of almost 03 months. The writ petition is dismissed accordingly.
