Petitioner has posed a challenge to order dated 17.04.2014/25.042014 passed by District Registrar Firms & Societies, Sonepat. By virtue of said order, District Registrar held that induction of 168 life members was not in consonance with the rules, regulations and bylaws. He, thus, rejected the proposal of the Committee to induct 168 life members.

Admittedly, no opportunity of hearing was afforded to the parties before passing the impugned order. Besides, the order contains no discussion about the alleged violation of the constitution of the society and other provisions. In my considered view, such an order is unsustainable. Same is hereby set-aside. Matter is remitted to same authority for decision afresh after affording an opportunity of hearing to effected parties. CWP No. 8182 of 2014 It has been assured on behalf of the State that a new schedule of election shall be published after fresh order is passed as directed by this court.

CM No. 9253 of 2017 & CM No. 9254 of 2017 As the main case has been disposed of, no order is required to be passed in these applications.
