***** HARKESH MANUJA J. (Oral) Present petition is directed against the eviction order dated 21.11.2017 passed by Rent Controller, Dasuya and affirmed vide order dated 12.10.2021 passed by learned Appellate Authority, Hoshiarpur. 2.

After arguing for sometime counsel for the petitioner would state that he does not press the petition on merit but the petitioner may be given reasonable time to make arrangement of alternative accommodation for his business.

In view of the above, eviction order dated 21.11.2017 passed by the Rent Controller, Dasuya and affirmed in appeal by the Appellate Authority, Hoshiarpur is confirmed, subject, however, to following conditions:- i) the petitioner shall hand over vacant possession of the tenanted premises to the respondent/landlord on or before 31.05.2023; ii) the petitioner shall furnish an undertaking before the Rent Controller, Dasuya within fifteen days from today that he will hand over SONIKA 2022.09.08 11:04 I attest to the accuracy and integrity of this document

CR-3647-2022 --2-- vacant possession of the tenanted premises to the respondent on or before 31.05.2023; and iii) the petitioner shall clear arrears of rent, if any, as per the findings recorded by the authorities below, within a period of one month from today and will continue to clear the arrears by seventh of each month, till 31.05.2023.

Failure of the petitioner to comply with either of the conditions would entitle the respondent/landlord to execute the eviction order forthwith.

Keeping in view the nature of proceedings, the present petition is being disposed off without issuing notice to the respondent, least it may further delay the proceedings.
