(ORAL) Through this revision the petitioner-tenant has laid challenge to the order dated 31.05.2019 (Annexure P-1) of the Appellate Authority, whereby stay order granted in his favour was vacated. At the outset, learned counsel for the petitioner inter alia contends that impugned order (Annexure P-1) may be set aside and Appellate Authority, be directed to decide the main appeal within two months from today.

Perusal of the file shows that impugned order (Annexure P-1) has been passed by the Appellate Authority, considering the fact that the revisionist was seeking repeated adjournments after obtaining stay in his favour against eviction order dated 27.04.2017 of the learned Rent Controller, with an ulterior motive and mala fide intention RISHU KATARIA 2019.09.03 15:09 I attest to the accuracy and integrity of this document

Since, learned counsel for the petitioner has prayed for directing the Appellate Authority to decide his appeal within two months from today, therefore, the instant revision petition is accepted and impugned order (Annexure P-1) is kept in abeyance for two months. The Appellate Authority is directed to decide the main appeal within two months positively, as prayed, clarifying that in case, the petitioner or his counsel seeks even a single adjournment, the same shall not be entertained and the appeal shall be decided without hearing him.
