(Oral) After arguing for some time, learned counsel for the petitioner concedes that neither the specific order of dismissal dated 21.01.2003 Annexure P-9 is under challenge in the instant writ petition nor the Appellate Authority's order dated 03.08.2004 Annexure P-8 upholding the said dismissal order has been assailed herein. Confronted with this situation learned counsel for the petitioner seeks liberty to withdraw the present writ petition to avail appropriate remedy, subject of course to the law of limitation. Prima facie this Court is of the view that challenge to the said dismissal order as well as the Appellate Authority's order is barred by inordinate delay.

Be that as it may, the present writ petition is dismissed as withdrawn with liberty as prayed for.
