The petitioner's claim has been turned down vide the impugned order on the premise that he failed to apply within the stipulated period. Such a condition has been annulled by this Court in Haryana Urban Development Authority and others versus Sandeep and others, 2012(2) Law Herald (P&H).

In this view of the matter, the action of the authorities cannot sustain and the impugned order to that extent is set-aside.
