(ORAL) In the present writ petition the claim which has been made by the petitioner is that even though he was appointed on daily wage basis prior to 01.01.2004, but he was regularized on the said post on 17.10.2012. Hence, he was entitled to be considered under old pension scheme for grant of pensionary benefits in view of the judgment of this Court passed in CWP No.2371 of 2010 titled 'Harbans Lal Vs. State of Punjab and others ' , decided on 31.08.2010 (Annexure P-3), which has attained finality up to the Hon'ble Supreme Court. Notice of motion was issued on 05.10.2018 and Mrs. Anu Chatrath Kapur, Additional Advocate General, Punjab, accepted notice to verify the facts.

CWP-25577-2018 -2Today, learned State counsel, on instructions from ASI Rajinder Singh, office of DGP, Intelligence, Punjab, states that keeping in view the judgment of this Court in Harbans Lal's case (supra), the case of the petitioner will be considered under the old pension scheme for the grant of pensionary benefits.

Keeping in view the statement so made, counsel for the petitioner states that he has no further grievance left to be addressed in the present writ petition and the same has been rendered infructuous. In view of the statement given by learned State counsel, the present writ petition is disposed of as having been rendered infructuous.
