(Oral) The petitioner seeks release of Assured Career Progression (ACP) proficiency step up for 4,9 and 14 years of service along with interest on the ground that similarly situated persons have been granted the said benefit.

It is case of the petitioner that he had superannuated on 31.3.2014 from the post of Punjabi Lecturer. Respondent no.5-the Principal of the Government Senior Secondary School, Gumanpura (Amritsar) had recommended his case for grant of ACP vide letter dated 10.9.2014 (Annexure P/2). The same was forwarded to the competent authority and on account of objections raised, the case has been returned and sent back on 11.12.2014 (Annexure P/3). It is submitted that the matter is still pending consideration and reference is made to the communication dated 29.4.2015 (Annexure P/6) wherein respondent no.5 had again forwarded the case of the petitioner to respondent no.4. Counsel for the petitioner submits that he would be satisfied if a direction is issued to respondent no.3 to decide the case of the petitioner which sent by respondent no.5 vide letter dated 29.4.2015 (Annexure P/6) within some fixed time frame.

Civil Writ Petition No.6144 of 2016 -2Mr. R.S.Sidhu, Assistant Advocate General, Punjab accepts notice on behalf of respondents. Copies of the writ petition have been supplied to him.

Keeping in view the limited relief sought by the petitioner, this Court is of the opinion that there is no requirement of calling for any reply on behalf of the State.

Accordingly, without commenting upon the merits of the case, the present writ petition is disposed of with a direction to respondent no.3 or the competent authority to decide the case of the petitioner which has been sent by respondent no.5 vide letter dated 29.4.2015 (Annexure P/6) and pass an appropriate order in accordance with law within a period of three months from the date of receipt of a certified copy of this order. In case any adverse order is to be passed then a reasoned order be passed by the said respondent and be conveyed to the petitioner. The present writ petition is disposed off with the aforesaid directions.
