Present petition under Section 482 Cr.P.C. for quashing of impugned order dated 20.07.2019 (Annexure P3), passed by the Court of learned Additional Sessions Judge, Kurukshetra in case FIR No. 540 dated 21.10.2017, registered under Sections 148, 149, 323 & 325 IPC (Section 307 IPC was added lateron) at Police Station Pehowa, District Kurukshetra, whereby bail, granted to the petitioner, was cancelled and he was ordered to be produced in the Court against non-bailable warrants of arrest. Learned counsel for the petitioner contended that petitioner mistook the date and that is why he could not appear before the learned trial Court on the date fixed.
Perusal of the impugned order reveals that on the date fixed i.e. 20.07.2019, PW Satya Narain, Assistant Sub Inspector was present in the Court and was to be sent unexamined on account of non-appearance of the petitioner and the next date was communicated to the petitioner through his DEEPAK KUMAR BHARDWAJ 2019.08.28 15:22 I attest to the accuracy and integrity of this document
Criminal Misc. No. M-34965 of 2019 learned counsel only. As such, no case is made out to set aside the impugned order and present petition stands dismissed.
However, in case petitioner appears before the learned trial Court within a period of one week from today and moves an application for granting regular bail to him, the learned trial Judge shall consider and decide the same within a period of one week thereafter.
