**** HARNARESH SINGH GILL , J. (ORAL) The petitioner is seeking regular bail in FIR No. 81 dated 5.5.2018 registered at Police Station Sangat, District Bathinda under Sections 15/61 of Narcotic Drugs and Psychotropic Substances Act, 1985. Learned counsel for the petitioners state that 80 kilograms of poppy husk is alleged to have been recovered from the petitioner. The petitioner was accompanying other co-accused Jaswinder Singh, who has also been arrested. He further submits that the petitioner is in custody since 5.5.2018.
Learned State counsel, on instructions from Sub Inspector Baltej Singh, has submitted that in the other case, the petitioner was convicted.
Learned counsel for the petitioner submits that sentence in that GURPREET SINGH 2019.11.16 16:18 I attest to the accuracy and authenticity of this document chandigarh case was suspended by this Court vide order dated 25.9.2014. Copy of the
CRM-M No. 33827 of 2019 -2order has been placed on record.
The petitioner is in custody since 5.5.2018. Challan has been presented and the trial will take time to conclude. No useful purpose would be served by keeping the petitioner behind the bars. Without commenting anything on the merits of the case, the petition is allowed and the petitioner is ordered to be released on bail on his furnishing bail/surety bonds to the satisfaction of the trial Court/Duty Magistrate, Bathinda.
