State of Haryana and Others .....Respondents CORAM: HON'BLE MRS. JUSTICE ALKA SARIN

Present:

Mr. G.S.Sandhu, Advocate, for the petitioner. ALKA SARIN, J. (ORAL) Heard through video conferencing.

The present criminal writ petition has been filed under Article 226 of the Constitution of India for issuance of a writ in the nature of mandamus directing respondent Nos.1 to 3 to protect the life and liberty of the petitioner at the hands of respondent Nos.4 to 7. Learned counsel for the petitioner would contend that the petitioner is the Mahant of Teerth Yamkeshwar Temple and has repeatedly been receiving threats from respondent Nos.4 to 7. The learned counsel for the petitioner would further contend that the petitioner apprehends danger to his life and liberty. In this regard, a representation dated 01.10.2020 (Annexure P-3) has also been filed by the petitioner before the Superintendent of Police, Ambala. However, no action has been taken on the same. He further contends that at this stage, he limits his prayer in the present petition that his representation dated 01.10.2020 (Annexure P-3) be decided in a time bound manner. CRWP-9911-2020 (O&M) -2Notice of motion.

On the asking of the Court, Mr. Naveen Singh Panwar, DAG, Haryana, who has joined the session through video conferencing, accepts notice on behalf of respondent Nos.1 to 3/State. He has no objection if the present petition is disposed off with a direction to the Superintendent of Police, Ambala - respondent No.2 - to decide the representation dated 01.10.2020 (Annexure P-3) filed by the petitioner in a time bound manner.

In view of the limited prayer made by the learned counsel for the petitioner, the service of notice on the private respondents is dispensed with since the matter is not being decided on merits. The present petition is disposed off with a direction to respondent No.2 - Superintendent of Police, Ambala - to decide the representation dated 01.10.2020 (Annexure P-3) in accordance with law, within a period of 15 days from the date of receipt of certified copy of this order.

Disposed off.
