(ORAL) By virtue of instant petition preferred under Article 226/227 of the Constitution of India, petitioner has sought issuance of a writ in the nature of mandamus directing respondents No.3 and 4 to release terminal benefits including gratuity and leave encashment etc. and to pay interest @ 12% p.a. on the delayed payment.

A perusal of interim order dated 03.12.2015, transpires that entire amount of gratuity and leave encashment has already been released to the petitioner and as per the version of learned State counsel, instant petition has rendered infructuous. CWP No.7053 OF 2015 --2-- elapse, learned counsel for the petitioner is not even in a state to apprise this Court whether the aforesaid amount has been received or not. 3.

As such, the instant petition is dismissed as having been rendered infructuous. However, at the same time, petitioner is granted liberty that if he still feels aggrieved, to have recourse to the remedies available under law as well as to approach this Court.
