ALKA SARIN, J. (Oral) Learned counsel for the petitioner contends that the main suit in which ad interim injunction was granted on 28.01.2016 stood dismissed on 21.12.2021. It is further the contention of learned counsel for the petitioner that any order passed under Order XXXIX Rules 1 and 2 CPC stood merged with the final judgement passed on 21.12.2021 dismissing the suit. The impugned order in the present case was passed on an application for dismissal of the petition, which was dismissed vide order dated 12.07.2019. Learned counsel for the petitioner would further contend that since the interim order itself has merged into the final judgment and decree dated 21.12.2021, the present revision petition itself has been rendered infructuous.
In view of the above, the present petition is dismissed as having been rendered infructuous. Pending applications, if any, also stand disposed off.
