(ORAL) Present Contempt Petition has been filed by the petitioners under Section 12 of Contempt of Courts Act, 1971 for punishing the respondents for willfully disobeying the provision provided under Cr.P.C. as well as the orders passed by Hon'ble Supreme Court in case Pardeep Ram vs. State of Jharkhand and another (2019) 17 SCC 326 (Annexure P-8).

Learned counsel for the petitioners submits that an FIR No. 40 dated 22.05.2022 under Sections 420 and 120-B IPC was registered against the petitioners at Police Station City-II, Abohar, District Fazilka (Annexure P-1). In the said FIR, petitioners have been granted anticipatory bail vide order dated 02.07.2022 (Annexure P-2). It is

COCP-2347-2023 (O&M) -2 - submitted that thereafter, the respondent-Officer added certain Sections and again arrested the petitioners on dated 01.03.2023 without following procedure as per law.

Learned counsel for the respondents-State counters submissions made on behalf of the petitioners and refers to para 10 of the Short Reply dated 24.11.2023 by way of an Affidavit of Senior Superintendent of Police, Fazilka on behalf of respondent No.1; wherein it is stated that a notice under Section 41(1) of Cr.P.C. dated 10.02.2023 was duly conveyed to the petitioners through the mobile phone of petitioner No.1-Ravinder Kumar i.e. 98787 26376 with the information that the offences under Sections 465, 467, 468, and 471 of IPC have been added and they have to be arrested in the case; and therefore, advance notice of 14 days in accordance with law was duly given to them by ASI Bhupinder Singh/respondent No.3. It is submitted that thereafter in any event, departmental enquiry was initiated against respondent No.3 vide office order No.

28412-19/B dated 13.11.2023; whereafter vide office order dated 24.10.2024, service of 1 year has been deducted from his total service and also one increment has been removed from his salary. A copy of the office order dated 24.10.2024 is handed over in Court today, which is taken on record.

In view of the undisputed facts as stated above by learned counsel for the respondent-State, no further directions are required to be issued.

The present Contempt Petition stands disposed of.
