G.S.SANDHAWALIA, J. (Oral) The petitioner challenges the selection of respondents no. 3 to 14 made on 19.06.2014 (Annexure P-5) to the post of Junior Engineer (Civil) in the Irrigation Department and for quashing the criteria dated 07.01.2012 (Annexure P-7). The claim is based on the fact that the petitioner has been only awarded 9 marks in the interview whereas other candidates had been given higher marks in as much as 21 out of 25 though they had secured less marks on the basis of the academic qualifications. Resultantly, challenge has been raised to the criteria as such adopted by the Commission for the purposes of selection.

As noticed, a period of 3-1/2 years has expired since selection has been made. The petitioner has not explained in any manner as to what were the reasons for delay in approaching this Court. Even a civil suit for challenging the appointment would be barred after a period of 3 years. Settled matters of appointment cannot be allowed to be reopened at the asking of the unsuccessful candidates who have participated in the selection process but were unsuccessful.

In such circumstances, this court is of the opinion that entertaining the writ petition at a belated stage would not be justified and Shivani Gupta 2017.12.19 12:15 I attest to the accuracy and integrity of this document

CWP No. 27400 of 2017 accordingly, the same is dismissed in limine on the principle of delay and laches.
