(Oral) Prayer in this petition for grant of anticipatory bail to the petitioner in FIR No.316 dated 19.09.2020, registered under Section 22 of NDPS Act, 1985 at Police Station Lambi, District Sri Muktsar Sahib. Learned counsel for the petitioner submits that in pursuance of the order dated 26.11.2020, the petitioner has appeared before the Investigating Officer. He further submits that the petitioner was neither arrested at the spot nor any recovery was made as he was nominated on the disclosure statement of co-accused Gurpreet Singh.
Learned State counsel has filed the affidavit of Deputy Superintendent of Police, Sub-Division Malout, District Sri Muktsar Sahib and as per the affidavit, the factual position has not disputed. CRM-M-39221-2020 (O&M) Learned State counsel on instructions from ASI Sukhwinder Singh submits that the petitioner has joined the investigation and no more required for any further investigation.
