The instant petition has been filed under Section 438 Cr.P.C. for grant of anticipatory bail to the petitioner in case FIR No.136 dated 23.07.2019 registered under Sections 354, 323, 148, 149, 120-B IPC at Police Station Moga South, Tehsil and District Moga. 2.

By an order dated 21.08.2019 while issuing notice of motion, this Court had granted interim bail to the petitioners and directed them to join investigation.

Learned counsel appearing on behalf of the petitioners would contend that three of the petitioners namely Surjit Kaur, Satnam Singh and Veerpal Kaur have joined investigation.

Learned counsel appearing on behalf of the respondent-State on instructions from IO SI Amandeep Singh concurs about joining of investigation by three aforementioned petitioners, however, submits that Vicky did not join investigation, as it is stated that he has gone abroad and on investigation done by DSP City Moga, he has been found innocent. 5.

In view of the fact that petitioners No.1 to 3 have joined investigation and petitioner No.4 namely Vicky did not join investigation, however, on investigation he has been found innocent, the instant petition is allowed and the order dated 21.08.2019 granting interim bail to the petitioners is made absolute, subject to the conditions laid down in Section 438 (2) Cr.P.C.
