The petitioner has filed the instant petition under Article 227 of the Constitution of India, seeking issuance of a writ of mandamus directing the respondents to consider and engage/absorb the petitioner on direct contract/CHB basis in terms of PSPCL Policy Memo No.IRO-685 dated 09.05.2026 (Annexure P-11) with all consequential benefits including continuity of service, seniority and service protection. Further, seeking issuance of a writ of certiorari for quashing the action of the respondents in excluding the petitioner from the list/preparation of eligible candidates under the Policy dated 09.05.2026.

On receipt of advance copy of the petition, Ms. Mehak Aggarwal, Advocate has put in appearance on behalf of the respondentsPSPCL and submits that the petitioner was an employee of the contractor and his services have already been terminated, vide order dated 27.06.2025. She has produced a copy of letter dated 30.06.2025, whereby the petitioner was informed that his services were terminated VINOD KOTHIYAL 2026.07.01 15:25 I attest to the accuracy and authenticity of this document

CWP-18860-2026 -2with immediate effect from 27.06.2025, which is taken on record and copy thereof has been supplied to learned counsel for the petitioner. She further submits that in view of the law laid down by a Division Bench of this Court in Nishan Singh and others Vs. State of Punjab and others : 2014 (11) RCR (Civil) 262, the writ petition against the service provider is not maintainable.

Faced with this situation, learned counsel for the petitioner wishes to withdraw the instant petition with liberty to avail other legal remedies in accordance with law.
