**** SHALINI SINGH NAGPAL J.(ORAL) Petitioner seeks quashing of orders dated 27.02.2026 and 21.05.2026 of learned Additional Sessions Judge, Faridabad vide which his bail and surety bonds were cancelled and forfeited to the State in FIR No.97 dated 11.07.2020 under Sections 147, 148, 323, 452, 506 IPC and section 3 of Scheduled Castes &Scheduled Tribes Act, 1989.

Learned counsel for the petitioner submits that petitioner who was facing trial in afore-mentioned FIR, had been regularly appearing in the Court. However on 27.02.2026, when he could not appear due to certain constraints, his bail bonds were cancelled and forfeited to the State and non-bailable warrants were issued. Case was now fixed for 06.06.2026 and the petitioner had apprehension that he would be arrested. Learned counsel further submits that petitioner was ready to surrender in the Court but was fearful on account of non-bailable warrants of arrest and some KAPIL 2026.06.03 17:27 I attest to the accuracy and integrity of this document protection may be granted.

Mr. Kshitij Bharti, AAG, Haryana, accepts notice on behalf of respondent State and opposed the prayer made in the petition.

Petitioner was released on regular bail in the aforementioned FIR vide order dated 13.08.2020. Perusal of impugned order reflects that bail of the petitioner has not been cancelled, only his bonds have been cancelled and forfeited to the State. Since it appears to the Court that petitioner intends to join the proceedings and face trial, he must be permitted to do so. Petitioner is accordingly directed to put in appearance before learned Additional Sessions Judge, Faridabad on the next date fixed before the court and move requisite application for furnishing fresh bail and surety bonds. Till then, non-bailable warrants of arrest of the petitioner shall remain in abeyance. 6.
The petition stands disposed of, on the above terms. 7.
Pending miscellaneous applications, if any, stand disposed of.
