G.S.SANDHAWALIA, J. (Oral) The petitioner is challenging the stoppage of the annual increment imposed by the Chairman of the Market Committee Shri Muktsar Sahib (Annexure P-3). Counsel concedes that the said order is appealable before the Secretary of the Punjab Mandi Board. In such circumstances, the present writ petition is not maintainable since there is a alternative and efficacious remedy available. Faced with the above situation, counsel does not press the present writ petition with liberty to approach the said authority so that his appeal can be decided on merits.
Accordingly, the present writ petition is disposed of with liberty to the petitioner to approach the Appellate Authority, who shall decide the appeal on merits.
