(ORAL) (The aforesaid presence is being recorded through video conferencing since the proceedings are being conducted in virtual court) By way of filing the present petition, the petitioners have sought concession of anticipatory bail in case FIR No.188 dated 04.06.2015, under Sections 420 and 120-B IPC (Sections 465, 467 and 468 IPC added later on) registered at Police Station Sushant Lok, District Gurugram.

The allegations against the petitioners are that they were granted regular bail by the trial court but they misused the same and resultantly, the warrants of arrest were issued against them. CRM-M-39985-2020 --2-- petitioners. It is further evident from the impugned order that on account of delaying tactics of the petitioners, the prosecution evidence could not be completed despite the registration of FIR on 04.06.2015.

It is contended that the present petitioners have already been extended the concession of anticipatory bail vide orders dated 16.06.2020 and 11.06.2020 (P-9 and P-10 respectively). Notice of motion.

Mr. Parveen Kumar Aggarwal, DAG, Haryana appears and has accepted notice on behalf of the respondent-State. He opposes the bail petition tooth and nail and urged that the only intention of the present petitioners is to create hurdle in the smooth trial of the case, which is already pending for the last more than five years. He further submits that several other cases are pending against the petitioners and prayed for dismissal of the present petition. After having heard learned counsel for the parties and perusing the record, this Court deems it appropriate to give directions to the petitioners to surrender before the ld. trial court/Illaqa Magistrate on 11.12.2020 and move application seeking regular bail. However, in the meantime, there shall be stay on the arrest of the present petitioners.
