Petitioner has filed instant petition under Section 482 of BNSS, 2023 for grant of anticipatory bail in FIR No.17 dated 09.04.2024 under Sections 20 of NDPS registered at Police Station Dharamgarh, District Sangrur (Annexure P-1).

As per the facts of the case on 09.04.2024 ASI Beant Singh and his police party apprehended Lakhwinder Singh present by the side of road alongwith his scooter and from his possession 300 grams of sulpha along with transparent envelope in a cloth bag was recovered. During the course of interrogation, he named present petitioner Mukhtiar Kaur who is his mother. As per the order dated 01.08.2024 arrest of petitioner was stayed subject to joining of investigation.

Learned counsel representing State confirmed that in pursuance of order passed by this Court, petitioner has joined investigation on 14.08.2024. However, it is pointed out that present petitioner is involved in as much as 8 cases as detailed in para No.9 of the status report. 5.
I have considered the arguments and have gone through the record. So far as present case is concerned, no recovery is effected from her. She has already joined the investigation. This fact is confirmed by learned counsel representing State. So far as other FIRs are concerned, same will be decided on its own merits.

Therefore, without going on the merits of the case, in light of the aforesaid facts anticipatory bail filed by petitioner Mukhtiar Kaur is allowed #123 !
