MANJARI NEHRU KAUL, J. (ORAL) Prayer in this petition is for grant of anticipatory bail to the petitioner in FIR No.85 dated 22.04.2024 under Sections 406, 420 of the IPC registered at Police Station Model Town, District Hoshiarpur. 2.

Vide order dated 02.09.2025, the petitioner had been granted interim anticipatory bail with direction to join investigation and the relevant part of the said order reads as under:- "Learned State counsel, on being pointedly asked, has not disputed that the petitioner has no previous criminal antecedents; it has been further apprised on instructions that although as per allegations levelled in the FIR, Rs.6 lakhs had allegedly been handed over to the petitioner on the pretext of sending the complainant abroad, however, approximately Rs.1 lakh only stood deposited in the account of the petitioner. Learned counsel for the petitioner submits that no doubt an amount approximately Rs.1,50,000/- was indeed deposited in PUNEET SACHDEVA 2025.09.29 15:47 I attest to the accuracy and authenticity of this document Chandigarh

CRM-M-36377-2024 -2the account of the petitioner, however, it was due to some business transaction with the son of the complainant, which he was still willing to repay to the complainant positively on or before the next date of hearing."

Learned counsel for the petitioner submits that in compliance of order dated 02.09.2025, the petitioner has joined investigation and cooperated with the investigating agency. 4.

Learned State counsel, on instructions, does not dispute the factum of the petitioner having joined investigation and cooperated with the investigating agency. He, on further instructions, submits that the petitioner is not required for further investigation much less for his custodial interrogation.

In view of the above, the petition is allowed and interim order dated 02.09.2025, is made absolute subject to the conditions laid down in Section 438(2) Cr.P.C.
