Present petition has been filed under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for short 'BNSS') for grant of anticipatory bail to the petitioner in case FIR No.65 dated 24.5.2025, under Sections 118(1), 115(2), 191(3) and 190 of Bharatiya Nyaya Sanhita, 2023 (Section 117(2) of BNS, 2023 added later on), registered at Police Station City 1, Mansa, District Mansa. 1.1 Status report by way of affidavit of Butta Singh, PPS, Deputy Superintendent of Police, Sub-Division Mansa, District Mansa, has been filed in Court today. The same be kept on record. Copy thereof has been furnished to learned counsel for the petitioner. 2.

2. It is, inter alia, contended by learned counsel for the petitioner that the petitioner is innocent and has been falsely implicated in this case. He contends that although the petitioner is named in the FIR on the basis of party faction but no specific overt act nor any injury is attributed to the petitioner. He contends that the petitioner is not having any criminal antecedents. Hence, seeks anticipatory bail.

3. Notice of motion.

On the asking of the Court, Mr. Jatinder Pal Singh, Sr. DAG Punjab, present in Court, accepts notice on behalf of the State-respondent and, on the basis of paraivi report, admits the fact that no injury is attributed to the petitioner. He prays for time to file the status report/reply in the matter.

5. Adjourned to 15.07.2025.

6. Needful be done well before the date fixed with an advance copy to the counsel opposite.

In the meanwhile, the petitioner is hereby directed to join investigation within seven days from today and in the event of his arrest, he is ordered to be released on interim bail on his furnishing personal/surety bonds to the satisfaction of the Arresting Officer/Investigating Officer. He shall also abide by conditions as envisaged under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita 2023 (BNSS).

8. Investigating Officer (concerned) to remain present in Court along with relevant records on the date fixed.

Learned State counsel (on instructions) submits that pursuant to the order dated 30.6.2025, the petitioner has joined investigation and is no longer required for custodial interrogation.

In view of the above, the instant petition is allowed. The interim order dated 30.6.2025, passed by this Court is made absolute, subject to the conditions as enumerated under Section 482(2) of BNSS. 5.

This order should not be treated as "blanket" order. It will not be read granting petitioner indefinite protection from arrest. It shall be

CRM-M No.33508 of 2025 -3confined to the FIR mentioned ibid and will not operate in respect of any other incident that involves commission of an offence. 6.

Liberty is reserved in favour of State/complainant to move for cancellation/recall of this order in case the petitioner violates any condition stipulated under Section 482(2) of BNSS or upon showing any other sufficient cause.
