KARAMJIT SINGH , J. (Oral) In the instant petition, prayer is for grant of anticipatory bail to the petitioner in case bearing FIR No.149 dated 16.9.2021 registered under Sections 21, 29 of NDPS Act at Police Station Division No.2, District Pathankot.

The State counsel at the outset submitted that in compliance of the order dated 19.10.2021, the petitioner has joined investigation and is not required by the police for any further investigation. As per the prosecution version, 4.80 grams of 'Heroin' was recovered from co-accused Harish Kumar and Rajinder Kumar by the police on 16.9.2021 and consequently FIR in this case was registered against both GAURAV SOROT 2021.11.30 15:28 I attest to the accuracy and integrity of this document

( 2 ) CRM-M-43946-2021 the said two accused. The petitioner was nominated as an accused in the present case on the basis of alleged disclosure made by co-accused. The present case involves recovery of small quantity of contraband that too from co-accused Harish Kumar and Rajinder Kumar. The petitioner who has already joined the investigation is not required by the police for any further investigation. So, I am of the view that no purpose will be served even if the petitioner is sent to custody at this point of time. In the light of the above, this bail application is allowed and the order of interim bail dated 19.10.2021 is hereby made absolute subject to conditions envisaged under Section 438(2) Cr.P.C.
