Instant petition has been filed under Section 438 of the Code of Criminal Procedure, 1973 seeking anticipatory bail to the petitioners in case FIR No.60 dated 30.07.2019 registered under Sections 498-A, 406 and 120B of Indian Penal Code, 1860 at Police Station Bhaini Mian Khan, District Gurdaspur (Annexure P-1).
Counsel for the petitioners submits that FIR (Annexure P-1) has been registered by the father of Hardeep Kaur, who was married to the son of petitioners in the year 2015 and the allegations levelled against the petitioners as well as their son are regarding demand of dowry. He submits
CRM-M-34159 of 2019 {2} that FIR has been registered on account of marital discord between their son and daughter-in-law. He submits that pursuant to order dated 22.08.2019, petitioners have joined the investigation, though the mediation between the parties has failed.
Upon instructions from ASI Jagdeep Singh, State counsel has admitted the fact that the petitioners have joined the investigation and upon further instructions, he submits that challan has been presented and the charge has been framed.
In view of the above facts, but without commenting on the merits of the case, the present petition is allowed and the order dated 22.08.2019 granting interim bail to the petitioners is made absolute, subject to the conditions laid down in Section 438(2) of the Code of Criminal Procedure.
