RAJESH BHARDWAJ, J.(ORAL) Petitioner has approached this Court praying for issuance of direction to respondent No.2 to ensure that action be taken on the complaint made by the petitioner and further directing respondents No.3 and 4 to ensure the proper regulation of drainage of water accumulated in the village pond due to which the land measuring 6 kanal 19 marla owned by the petitioner has become useless and the crop sown by the petitioner is being damaged due to overflow of water from the pond. Learned counsel for the petitioner has submitted that the fields of the petitioner were damaged due to over flow of water in the pond. He submits that there is no provision for drainage of the excess water and risk to the crops in the fields would persist continuously. Notice was issued in this case and the respondents were directed MEENU 2023.10.19 14:13 I attest to the accuracy and integrity of this order/judgment

Learned counsel for the Panchayat has submitted before this Court that though the problem of over flow of water existed, however, thereafter separate pond has been dug out to adjust the excessive water and as on date the problem of overflowing of water does not exist. He has submitted that the Gram Panchayat is duty bound to take care of grievances of the petitioner and that of similarly situated farmers. He has further submitted that as and when any problem arises, the Panchayat would take remedial steps.

Learned counsel for the petitioner submits that in view of the statement made by learned counsel for the respondent/Gram Panchayat, his only grievance left is qua the compensation regarding the damage caused to his crops, however, for that he would seek alternative remedy before the appropriate Court.

In view of the above, the present petition is disposed of. Respondent/Gram Panchayat shall be bound by the statement suffered by its counsel today in the Court.
