The present Civil Writ Petition has been filed under Articles 226/227 of the Constitution of India for issuance of a writ in the nature of mandamus directing respondent Nos. 1 to 4 to provide assistance to the Authorised Officer for taking physical possession of the secured assets as per the provisions of Securitisation and Reconstruction of Financial Assets and Enforcement of Security Interest Act, 2002 (hereinafter referred to as 'the SARFAESI Act').

Learned counsel appearing on behalf of the petitioner through video conferencing submitted that the petitioner is Bank and a secured creditor. He submitted that after complying with the procedure prescribed under Sections 13(2) and 13(4) of the SARFAESI Act, the petitioner filed an application before the learned District Magistrate, Karnal under Section 14 of the SARFAESI Act seeking possession of the secured assets along RAKESH KUMAR 2026.07.02 17:59 I attest to the accuracy and authenticity of this order/judgment

CWP-18691-2026(O&M) -2with police assistance and has referred to Annexure P-5 dated 18.04.2026, whereby the aforesaid application was filed but till date no action has been taken by respondent No.2-District Magistrate, Karnal. He submitted that his limited prayer is only to the extent that a direction may be issued to the learned District Magistrate, Karnal to take action on the application filed under Section 14 of the SARFAESI Act within a time frame work. 3.

At this stage, Ms. Shubhra Singh, learned Additional Advocate General, Haryana has submitted that the application filed by the petitionerBank under Section 14 of the SARFAESI Act will be considered and appropriate action in accordance with law will be taken by respondent No.2/District Magistrate, Karnal, within a period of one month from today. 4.

Learned counsel for the petitioner has submitted that in view of the statement made by the learned State counsel, the present petition may be disposed of.
