Learned counsel for respondent No. 2 drew the attention of the Court to the order dated 06.04.2016 whereby this Court had issued notice of motion on the only point as to whether respondent No. 2 is covered by the provisions of the Securitization and Reconstruction of Financial Assets and Enforcement of Security Interest Act, 2002 ( for short 'the SARFAESI Act'). The relevant portion of the aforesaid order reads thus:- "The only point on which notice of motion is issued is as to whether respondent No. 2 is covered by the provisions of the Securitization and Reconstruction of Financial Assets and Enforcement of Security Interest Act, 2002." 2.

CWP-6514-2016 -2Annexure R-1 dated 21.01.2011 appended with the short reply on behalf of respondent No. 2 wherein respondent No. 2-Religare Housing Development Finance Corporation Limited, has been declared as a Financial Institution under the the SARFAESI Act.

On the last date of hearing i.e. 11.08.2016, no one had appeared on behalf of the petitioner. Even today, none has appeared on behalf of the petitioner.
