For the reasons mentioned in the application, the same is allowed and copies of Air Ticket of parents of the applicant-petitioner, medical record of the applicant-petitioner and Notice bearing No.410-RH dated 01.07.2025, are taken on record as Annexures P-12 to P-14 respectively. The application stands disposed of.

Main Case :

Prayer in the instant petition, filed under Section 528 of the Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023, is for issuance of directions to respondents No.1 to 5 to take an appropriate action on the representation/complaint dated 12.06.2025 (Annexure P-7), moved by the petitioner against private respondents no.6 to 11, in accordance with law. Learned counsel for the petitioner has contended that the petitioner

is presently residing in England and has filed the present petition through his father and Power of Attorney namely Inderpal Singh. Before moving to England, during the year 2019-2022, the petitioner used to work as Student Consultant in an Immigration Company namely United Global Services and during that period, she came in contact with Gagandeep Kaur (respondent no.6), who was a relative of one of his clients. Respondent no.6 was keen to go to U.K. and started taking guidance in this regard from the petitioner. It is further submitted by learned counsel for the petitioner that respondent no.6 was an illiterate lady and was unable to understand the visa procedures etc. So, the petitioner informed her that due to absence of any qualification or skill, she had no chance of getting work visa etc. However, respondent no.

6 insisted the petitioner to accompany her to Doaba Immigration to get her work done. Though the petitioner accompanied her but was not satisfied with their replies and guided her not to pursue ahead. Respondent no.7 Jatinder is husband of respondent no.6 and respondents no.8 to 11 are associated with the aforesaid Doaba Immigration as owners and partners. The petitioner shifted to U.K. in July 2023. After some time, respondent no.6 gained sympathy of petitioner and her family, stating that she had paid Rs.18.5 lakhs to aforesaid Doaba Immigration but they failed to get her visa and on this count, her husband was annoyed with her. In the month of October 2023, husband of the petitioner came to India and purchased a house in Kharar and having good relations, respondent no.6 was allowed to stay in that house. Later, respondent no.

6 again tried to get visa for U.K. through one Vivek Sharma and petitioner again helped her with lakhs of rupees in order to get her settled. But again, visa was not approved.

In the meantime, the petitioner came to know through neighbours that many people were visiting their house, where respondent no.6 was living. Upon this, petitioner asked her to vacate her house and make arrangements for some rented accommodation somewhere else. From that day, she is creating problems one after the other for the petitioner and her family members. In fact, she is intending to grab the petitioner's property. Even fake posters, misusing the technology, were put outside their house, mentioning the same to be a disputed house and petitioner and her family to be the fraudsters. Even threatening calls were made by husband of respondent no.6 to the petitioner. So, the petitioner made a detailed representation dated 12.06.2025 (Annexure P-7) to respondent no.7 for redressal of her grievances.

Some complaints were also made by respondent no.6 as a counterblast to the aforesaid representation dated 12.06.2025 and petitioner is getting notice(s) to appear in the same. It has also been alleged that the petitioner has come to know that respondents no.8 to 11 are planning to implicate the petitioner and her family falsely in some cases and therefore, they are apprehending danger at the hands of private respondents. Learned counsel for the petitioner has prayed that he would be satisfied if the aforesaid detailed representation dated 12.06.2025 (Annexure P-7) is ordered to be decided.

Notice of motion.

Ms. Gagandeep Kaur, DAG, Punjab accepts notice and submits that she has no objection if the aforesaid representation dated 12.06.2025 (Annexure P-7) is directed to be decided.

In view of the above, the present petition is disposed of with a

direction to respondent No.3 - Senior Superintendent of Police, District S.A.S. Nagar (Mohali), Punjab to look into the aforesaid representation at the earliest and to take appropriate action, if any required, in accordance with law.
