Present petition has been filed under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for short 'BNSS') for grant of regular bail to the petitioner in case FIR No.153 dated 17.5.2024 under Sections 302, 328 and 120-B of IPC, registered at Police Station Parao, Ambala Cantt., District Ambala.

Fresh vakalatnama filed on behalf of the petitioner is taken on record.

Since the prime prosecution witness namely Sandeep (FIRcomplainant-brother of the deceased) is yet to be examined as a prosecution witness, learned counsel for the petitioner seeks to withdraw the petition in hand at this stage.

The trial Court is directed to make an earnest endeavour for recording the statement of the said Sandeep (FIR-complainant-brother of the deceased) at the earliest.
