       This petition had been filed by the petitioners in the year 2017 challenging the notification dated 05.09.2017 issued by the Ministry of Road Transport and Highways, Government of India. Evidently, though the petition has been filed challenging the aforesaid notification, the Government of India or the Ministry of Road Transport and Highways has not been impleaded as party to the petition. The aforesaid respondent is a necessary party to the petition. The petition filed by the petitioner without impleading the aforesaid necessary party to the petition is not maintainable and accordingly the petition is dismissed for non-joinder of necessary party.
