(Oral) The prayer is made in this writ petition for quashing of the notice application dated 28.04.2011 (Annexure P-3), filed by the respondents in the Court of Collector, Gurgaon, under Sections 4 & 7 of the Haryana Public Premises & Land (Eviction & Recovery) Act, 1972. Further prayer has also been made seeking restraint on respondent No.2 from interfering in the peaceful possession of the petitioner with respect to plot No.177, Sector 6, IMT Manesar, Gurgaon.

After arguing for sometime, learned counsel for the petitioner states that he may be allowed to withdraw the instant writ petition with liberty to the petitioner to file an appropriate application before the Collector raising all the pleas as have been raised in the present writ petition.

Dismissed as withdrawn. It shall, however, be open to the petitioner to take recourse to the remedies available to it in accordance with law.
