JASGURPREET SINGH PURI , J. (ORAL ) The present petition has been filed under Section 482 of the Code of Criminal Procedure with a prayer for setting aside the order dated 9.7.2018 (Annexure P2), passed by the learned Judicial Magistrate First Class, Jalandhar, declaring the petitioner as a proclaimed person in FIR No.78 dated 12.09.2013, under Sections 420 and 120-B IPC, registered at Police Station Lambra, District Jalandhar City. The learned counsel for the petitioner has submitted that although the petitioner was absent from 15.5.2017 and could not attend the RAJ KUMAR ARORA 2020.11.27 15:06 I attest to the accuracy and integrity of this document
CRM-M-39579-2020 (O&M) proceedings of the Court but now the petitioner is willing to submit himself before the Court and join the proceedings and therefore, the order 9.7.2018 (Annexure P2) be set aside so that he may appear before the trial Court. After hearing the learned counsel for the petitioner, I am of the considered opinion that the petitioner remained absent for a period of more than three years. He has already been declared a proclaimed person vide order dated 9.7.2018 and more than two years have also elapsed since then and therefore, in such like cases, no case for interference is made out. In view of above, the present petition is dismissed. November 27, 2020.
