The present petition has been filed under Section 528 of Bharatiya Nagarik Suraksha Sanhita, 2023 for issuance of directions to respondents No.1 to 4 to take strict legal action as per law against respondent No.5 who is unnecessarily harassing the petitioner to grab his land and to provide adequate police protection to the petitioner to enable him to cut his poplar trees standing on his own land as well as to protect the life and liberty of the petitioner and his family members. Further, for issuance of directions to respondent No.3 to take appropriate legal action on the representation dated 20.05.2026 (Annexure P-8). 2.

As per petition, the petitioner along with his wife are owners in possession of land measuring 46 kanals 2 marlas comprised in khewat No.244/230, khatauni No.287, khasra No.59//4/2/1 (0K-8M), 59//7/1/3 (1K3M), 59//14 (8K-0M), 59//17 (8K-0M), 59//24 (8K-0M), 64//4 (8K-0M), 64//7 (8K-0M) khasra No.64//14/2(4K-11M). Revenue Officials on 14.06.2025 checked the revenue record and carried out demarcation. They found

-2petitioner's wife owner in possession of aforesaid land. It was also found that mining was illegally carried out on their land. He has filed representation dated 20.05.2026 seeking police protection to enable him to cut poplar trees standing over his land.

Learned counsel for the petitioner inter alia contends that the demarcation carried out by the revenue authorities on the basis of the revenue record duly establishes the ownership and possession of the petitioner's wife over the land in question. He further submits that respondent No.5 along with other anti-social elements is illegally carrying out mining over the said land and is preventing the petitioner from cutting the poplar trees standing thereon. It is further contended that despite submission of representation dated 20.05.2026 seeking police protection, the same has not been decided till date. 4.

Learned counsel for the petitioner further submits that the petitioner would be satisfied, in case a direction is issued to respondent No.2/competent authority to consider and decide the representation dated 20.05.2026 (Annexure P-8) submitted by him in a time bound manner. 5.

Notice of motion to the official respondents only. 6.

On asking of the Court, Mr. Bhanu Pratap Singh, Addl.A.G., Punjab accepts notice on behalf of the official respondents-State. Learned counsel for the petitioners is directed to supply copy of complete paper book to learned State counsel during the course of the day. 7.

Keeping in view the prayer made by the petitioner and without commenting anything on the merits of the case, present petition is disposed of

-3with a direction to respondent No.2/competent authority to consider and decide the representation dated 20.05.2026 (Annexure P-8) submitted by the petitioner within a period of four weeks from the date of receipt of certified copy of this order, in accordance with law. Further, the decision taken thereof shall be conveyed to the petitioners. Needless to say, if the petitioner is found entitled to the relief sought, the same shall be granted forthwith by respondent No.2/competent authority.
