(ORAL) Learned Advocate General, State of Punjab, on instructions from Ms. Anindita Mitra, Director, Department of Food Civil Supplies and Consumer Affairs, Punjab, who is present in the Court, states that the order impugned in this petition shall be withdrawn during the course of the day. In view of the statement made, we do not wish to proceed any further in the matter.

In the facts and circumstances, we deem it appropriate that the matter be relegated back to the Principal Secretary, Department of Food Civil Supplies and Consumer Affairs, Punjab, to adjudicate upon the issue in accordance with the directions contained in the judgment and order, dated 23.08.2018, passed in CWP No. 20912 of 2018 (The Faridkot PRASHANT KAPOOR 2018.10.12 14:45 I attest to the accuracy and authenticity of this document

Needless to say that the Principal Secretary shall pass a reasoned and speaking order after notice and opportunity of hearing to all the stakeholders. At this stage, learned Advocate General, State of Punjab, made a statement that the Principal Secretary shall pass an order after considering the matter, latest by 16.10.2018.

Till then status quo in respect of the tender process shall be maintained by all the parties.
