The petitioner has approached this Court seeking issuance of directions to official respondents to protect her life and liberty as she apprehends threat to the same at the hands of her husband i.e. respondent No.4-Jitender Sharma with whom she is having strained relations.

Learned counsel for the petitioner submits that there are strained relations between the petitioner and her husband i.e. respondent No.4-Jitender Sharma and a petition under Section 13 of Hindu Marriage Act is pending. It has been submitted that respondent No.4 had been ill treating the petitioner and had thrown her out of her matrimonial home and that the petitioner had taken PANKAJ KAKKAR 2021.10.28 15:43 I attest to the accuracy and integrity of this document
( 2 ) CRWP-10281-2021 (O&M) refuge in the house of one Shiv Kumar and infact intended to marry said Shiv Kumar after her marriage with respondent No.4-Jitender Sharma is dissolved. It has been submitted that respondent No.4 has, however, been threatening to cause harm to the petitioner and though the petitioner had submitted a representation (Annexure P-2) to the police but no action has been taken thereupon.

Having heard the learned counsel for the petitioner and while refraining from making any expression as regards merits of the case or as regards veracity of the averments made in the petition, the instant petition is disposed off with a direction to respondent No.2-Senior Superintendent of Police, Ropar, District Ropar to look into the matter and to dispose off the representation (Annexure P-2) expeditiously in accordance with law. In case, it is found that there is any genuine threat to life and liberty of the petitioner, then it be ensured that no harm is caused to the petitioner. 4.
It is, however, clarified that the aforesaid order shall not be taken to be any expression as regards the alleged relationship of the petitioner with Shiv Kumar and shall not confer any immunity upon the petitioner, in case it is found that she has committed any wrong.

A copy of this order alongwith copy of representation (Annexure P-2) be conveyed to respondent No.2-Senior Superintendent of Police, Ropar, District Ropar for necessary compliance.
