AUGUSTINE GEORGE MASIH, J. (ORAL) Challenge in this appeal is to the order dated 08.10.2021 passed by the learned Single Judge, whereby the writ petition preferred by the appellant stands dismissed, with liberty to the appellant to avail of its statutory remedy before the Appellate Authority. Having heard learned counsel for the parties, we are of the considered view that there are disputed question of facts which need to be decided and, therefore, the non-exercise of powers under Article 226 of the Constitution of India, by the learned Single Judge, cannot be faulted with.

LPA-981-2021 (O&M) -2to the appellant which the appellant states he would avail of within a period of two days from today. He further states that along with the appeal he would move an application for stay of the impugned order dated 04.10.2021 (Annexure P-1) in the writ petition, where at least the stay application be decided, at an early date. Learned counsel for respondent No. 7-Caveator, has no objection to the prayer made by learned counsel for the appellant. In view of the above, a direction is, thus, issued to the State Registrar of Societies, Haryana-respondent No. 3, to consider the appeal. If, an application for stay is preferred by the appellant a decision be taken thereon, within a period of 10 days of submission of such an application. The instant appeal stands disposed of, with the above observations.
