Seeking quashing of undated and unnumbered notice served upon the complainant and for further directions to the respondent No.2 to file status report in case titled as "Jatinder JB Singh Vs. Mahabir and Others", COMI-30/2024, and for further directions to concerned trial Court to pass appropriate orders in a time bound manner , the petitioner has come up before this Court under Section 528 and 529 BNSS, 2023. 2.

Counsel for the petitioner submits that the petitioner is aggrieved by the sloth speed of the Investigation whereas that of the Court is not that slow, due to which matter is hanging fire.

It would be appropriate to refer to order dated 17.07.2024 passed by the trial Court which reads as follows:

"Today the case was fixed for awaiting status report. Status report not received. SI Satbir Singh appeared and requested to give some time as the enquiry is still pending in complaint u/s 156(3) Cr.P.C. received through post. He stated that all the three GPA as mentioned in the complaint executed at Ahmadnagar, Maharashtra have been found fake but the executants of that GPA have not yet been joined in the enquiry and so the status report could not be filed. Heard. In the interest of justice, now the case is adjourned to 08.08.2024 for awaiting of status report."

Given above, without commenting on the above said observations, this Court generally refrains from issuing any direction to the trial Court to expedite the trial Court but in this case, keeping in view the prayer of petitioner, requests the trial Court to ensure that the matter is not adjourned unnecessarily. 5.

Petition is disposed of with the observations mentioned above. All pending applications, if any, stand disposed of.
