(ORAL) In the present case, the petitioners are claiming the benefit under the letter dated 23.03.2017 (Annexure P-7) for the grant of benefits to the members of the Employees Pension Scheme, 1995. It has been contended that after the order passed by the Hon'ble Supreme Court in SLP(C) No.33032-33033/2015, the petitioners became entitled for the benefit as upheld by the Supreme Court with regard to the grant of benefit of actual salary in respect to the ceiling fix by the respondents for the Employees' Pension Scheme of 1995. Counsel for the petitioner states that for the relief which has been sought in the present writ petition, the petitioners have served respondents with a legal notice on 13.04.2018 (Annexure P-8) and as per NARESH KUMAR 2018.12.19 15:51 I attest to the accuracy and integrity of this document Chandigarh

CWP-26261-2018 -2the reply received from the respondents, vide letter dated 13.06.2018 (Annexure P-9), their claim is not being denied and the same is kept pending by the Employees Provident Fund Officer, Karnal. In view of the above, the present petition is disposed of with the direction to respondent No.4 to pass the appropriate orders on the legal notice dated 13.04.2018 (Annexure P-8) within a period of three months from the date of receipt of a certified copy of this order. It is made clear that this Court does not express any opinion on the merits of the case as well as about the entitlement of the petitioners with regard to the claim made in the above-said legal notice at this stage. Present writ petition stands disposed of.
